What You Can Expect During The Mediation Process

Mediation uses a neutral third party called a mediator. The mediator occupies a central role in this process and works with the parties, together and separately, to try to resolve differences related to divorce, child custody, parenting time, support and issues involving property division.

Typically, the mediator will first have a telephone conference to discuss the major issues in the case with the attorneys for each party. After this conference, each attorney will send the mediator any pertinent information that he or she would like considered.

At the mediation itself, the parties and their respective attorneys will sign a confidentiality agreement and neither party will be able to use what is discussed or negotiated against the other party in any subsequent court proceedings. The mediator will meet with the attorneys and clients together to go over the procedure, and then the parties will separate into two conference rooms where negotiations begin.
